Description

The dispute arises from the authority's decision to suspend processing of the building consent application and require the applicant to reduce the size of the area enclosed by the pool barrier ('the immediate pool area'), and to remove a gate to the pool barrier from the driveway.

The matters for determination are whether the immediate pool area and the gate to the pool barrier from the driveway as proposed in the application for building consent comply with Clause F4 of the Building Code (First Schedule, Building Regulations 1992).
