Description
This determination arose from the decision of the authority to issue a notice under section 124(1)(c) of the Building Act for a five storey building because the authority was satisfied the building was earthquake-prone as defined in section 122 of the Act.
The authority had not completed all the service requirements for the purposes of section 125, pending the outcome of this determination.
The matter to be determined was therefore whether the authority had correctly exercised its powers of decision in issuing the earthquake-prone building notice under section 124 of the Act.
