Regarding the refusal to issue a code compliance certificate for failure to comply with Building Code Clause F4 for a batter slope at 23 Melksham Drive, Churton Park, Wellington

Scope

This determination arises from the decision of the authority to refuse to issue a code compliance certificate as it was not satisfied that the batter slope complied with Building Code Clause F4 Safety from Falling. The authority required a safety barrier be erected at the rear boundary situated at the top of the batter slope.

The matter to be determined therefore is whether the authority was correct to refuse to issue the code compliance certificate for the house with respect to Clause F4 of the Building Code (First Schedule, Building Regulations 1992).
