Description

This was a second determination about the applicants' townhouses and remedial building work carried out on them.

In November 2008, Determination 2008/105 was issued about remedial work undertaken on the first floor decks of the units, including the stairs, and the authority's decision to issue a code compliance certificate in respect of that work.

The first determination reversed the authority's decision.

This determination arose from the authority's decision to issue notices to fix for the remedial work, addressed only to the applicants as the owners.

The applicants disputed the decision to issue the notices to fix only to the owners and consider that the notices should have also been issued to the guarantor.

The view taken was that the matter to be determined was whether the authority's decision to issue the notices to fix that was addressed only to the applicants as the building owners was correct.
