This determination arises from the decision of the authority to refuse to issue a code compliance certificate for 11- to 13-year-old additions and alterations to an existing house. The matter to be determined is therefore whether the authority was correct to refuse to issue a code compliance certificate. In deciding this, I must consider: whether the building work complies with the clauses of the Building Code relevant to these additions and alterations; and whether the authority correctly exercised its powers of decision in respect of a refusal to issue a code compliance certificate.
