Description

The determination arises from the authority's decision to refuse to grant building consent for work to seismically strengthen the Hare Memorial Building, on the grounds that the proposed building work does not comply with the requirements in Clause D1 of the Building Code for access for people with disabilities. Therefore, the matter to be determined is whether the authority correctly exercised its powers of decision in refusing to grant building consent. In considering this matter, I must also consider whether the proposed building work complies with Clause D1.3.2 of the Building Code to the extent required by the Act.
