Scope

This determination arose from the authority's decision to refuse to issue a code compliance certificate and to issue a notice to fix because it was not satisfied that the completed building work complied with Clauses B1- Structure, B2-Durability, E2-External moisture, and H1-Energy efficiency provisions of the Building Code.

The matters to be determined was whether the authority correctly exercised its power when it:

• refused to issue a code compliance certificate for the alteration to an existing house; and
• issued a notice to fix for the alteration.
