Description

The matter to be determined is whether the authority correctly exercised its powers in refusing to issue a code compliance certificate for Unit 4. The authority is of the view that while Unit 4 was considered code compliant, the building consent under which Unit 4 has been constructed cannot be amended to allow for a code compliance certificate to be issued in respect of Unit 4 only. Therefore the reliance of Unit 4 on compliance of the adjacent units and whether the building consent can be amended to allow for a separate building consent for Unit 4 need to be considered.
