Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for the eight year old house and garage because it was not satisfied that the building work complied with certain clauses of the Building Code. The matter to be determined is whether the authority correctly exercised its powers when it refused to issue a code compliance certificate for the house and garage. In deciding this the following must be considered: 1-Whether the external envelope of the building work complies with the Clauses E2 External Moisture and B2 Durability of the Building Code. The external envelope includes the cladding, its configuration and components, junctions with other building elements, formed openings and penetrations, as well as the way the components have been installed and work together; 2-Whether the house complies with other relevant Building Code clauses identified in the notice to fix: E3 Internal Moisture, F2 Hazardous Building Materials, F4 Safety from Falling, and G4 Ventilation; 3-Whether the elements that make up the building work comply with Clause B2 Durability of the Building Code, taking into account the age of the building work.
