Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for the building because it was not satisfied that the building complied with certain clauses of the Building Code.

The authority's primary concerns about the compliance of the building related to its age and to the lack of inspection records for the construction of the building.

The matter determined was whether the authority was correct in its decision to refuse to issue the code compliance certificate.

It was considered:

  1. Whether the external claddings to the building complied with Clause B2 Durability and Clause E2 External Moisture;
  2. Whether various other elements in the building work complied with Clauses B1 Structure, E3 Internal Moisture, and F4 Safety from falling;
  3. Whether the elements that make up the building work complied with Clause B2 Durability, taking into account the age of the building.
