Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a 6-year-old house because it was not satisfied that it complied with the building consent and with certain clauses of the Building Code (First Schedule, Building Regulations 1992).

The matters for determination, in terms of sections 177(a), 177(b)(i) and 188 of the Act, are:

  1. Whether the brick cladding as installed on the house complies with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
  2. Whether the building elements comply with Clause B2 Durability of the Building Code, taking into account the age of the building work.

The applicants engaged a member of the New Zealand Institute of Building Surveyors to inspect and report on the cladding. The expert sought further advice from a specialist consultant in regard to the brick.
