This determination arises from the decision of the authority to refuse to issue a code compliance certificate and issue a notice to fix for a 15-year-old house because it was not satisfied that it complied with certain clauses of the Building Code.

In order to determine whether the decision to issue the notice to fix was correct, the matter for determination, in terms of sections 177(a) and 188 of the Act, is whether the external envelope of the house complies with Clause B2 Durability and Clause E2 External Moisture of the Building Code.

The notice to fix cites contraventions of Clauses B1, B2, D1, E1, E2, E3 and H1 of the Building Code.
