This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a four-year-old house (?Unit 2?) because it is not satisfied that it complies with Clause E2 of the Building Code (First Schedule, Building Regulations 1992).
The matters for determination, in terms of sections 177(a) and 177(b)(i) of the Act, are:
- (a) whether the cladding as installed on the building complies with Building Code Clause E2 External Moisture and consequently Clause B2 Durability;
- (b) whether the authority was correct in its decision to refuse to issue a code compliance certificate.
