The determination arises from the authority's decision to decline to issue a code compliance certificate for a six-year-old house.

The matter for determination, in terms of sections 177(a), 177(b) and 188 of the Act is whether the authority's decision to refuse to issue the code compliance certificate is correct and therefore must consider the following:

  • Whether the external envelope of the house complies with Clauses B2 Durability and E2 External Moisture of the Building Code;
  • Whether the remaining building elements comply with the relevant clauses of the Building Code;
  • Whether the building elements comply with the Building Code Clause B2 Durability taking into account the age of the building work.
