This determination arises from the decision of the authority to refuse to issue a code compliance certificate ('CCC') for a 9-year-old building because it is not satisfied that the building work complies with certain clauses of the Building Code (First Schedule, Building Regulations 1992).
The matters for determination are:
- Whether the cladding as installed on the building ('the cladding') complies with Clause E2 'External Moisture' of the Building Code;
- Whether the elements that make up the building comply with Building Code Clause B2 'Durability', taking into account the age of parts of the building.
