Description

The determination arises from the authority's decision to issue a code compliance certificate for work to a relocated house and the resulting dispute between the applicant and the authority is about the adequacy of the remedial work required to make the work code compliant.

The matters for determination in terms of sections 177(a) and 188(b) of the Act are:

  1. Whether the authority's decision to issue a code compliance certificate for the house was correct;
  2. Whether the scope of the remedial work proposed by the authority ('the remedial work') is sufficient to result in the building work complying with the Building Code.

Both parties agree that the foundations, subfloor and decks do not comply with the Building Code in various respects. The concerns raised by the applicant are restricted to the foundations, the subfloor and the decks of the house, and this determination is therefore limited to considering those elements of the consented building work.
