The determination arises from the decision of the authority to refuse to issue a code compliance certificate for two additional classrooms ('Classrooms 18 and 19') at a school complex. The original determination application was in respect of Classroom 19 only, but during the course of this determination, the parties have agreed that it should also include Classroom 18.

The matter for determination, in terms of sections 177(a) and 1882, is whether Classrooms 18 and 19 are required to comply with Clause D1.3.2 of the Building Code.
