The application arises from the authority's refusal to issue an amendment to a building consent in respect of a pool area and its associated safety barriers. For the reasons set out below, the matters for determination, in terms of sections 177(a), and 177(b)(vi), are:

  • (a) Whether the proposed amendment to the pool area and its associated safety barriers complies with clause F4 of the Building Code (The first Schedule to the Building Regulations 1992);
  • (b) The authority's decision to refuse to issue an amendment to the original building consent.
