Description

The matter for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for a 1-year old house is correct.

The refusal arose because the building work had been undertaken under the supervision of a building certifier which was duly registered as a building certifier under the former Building Act 1991, but which lost its approval as a building certifier before it had issued a code compliance certificate for the building work. The territorial authority considers that the appropriate certificate to be issued is a certificate of acceptance, as it cannot be satisfied that the building work as a whole complies with the Building Code.
