Description

The matter for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for 4-year-old alterations and additions to a house was correct.

The refusal arose because the building work had been undertaken under the supervision of Bay Building Certifiers, which was duly registered as a building certifier under the former Building Act 1991 but which lost its approval as a building certifier before it had issued a code compliance certificate for the building work.

The territorial authority considered that the appropriate certificate to be issued was a certificate of acceptance, as could not be satisfied that the building work as a whole complied with the Building Code.
