Description

The dispute for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for a 6-year-old house because it was not satisfied that the monolithic cladding to the walls of the house complied with clauses B2 Durability and E2 External Moisture of the Building Code is correct. The questions to be determined are: Issue 1: Whether the monolithic wall cladding as installed to the walls of the building  complies with the Building Code (see sections 177 and 188 of the Act). Issue 2: Whether certain building elements, which have 5 and 15-year durability requirements, comply with clause B2 of the building code considering the time that has elapsed since the elements were constructed.
