Description

The application arose from the territorial authority's issuing of a notice to fix for a 3-year-old semi-detached Unit requiring changes to be made to its monolithic cladding system.

This occurred even though the territorial authority had already issued an interim code compliance certificate in respect of the Unit.

The question to be determined was whether on reasonable grounds the monolithic wall cladding as installed to the timber-framed external walls of the Unit complied with the Building Code.
