Description
This is a determination under section 17 of the Building Act 1991, as amended by section 424 of the Building Act 2004, made on behalf of the Chief Executive of the Department of Building and Housing.
The applicant is the owner acting through a firm of architects. The only other party is the territorial authority.
The matter for determination is a dispute about access for people with disabilities to certain upper floor areas of a proposed new supermarket, and specifically whether the supermarket building as proposed without lift access to those areas complies with clause D1.3.4(c) of the building code.
