Description
This is a determination of a dispute under Part 3 Subpart 1 of the Building Act 2004 made on behalf of the Chief Executive of the Department of Building and Housing.
The applicants are the owners, and the other party is the North Shore City Council.
The application arises because no code compliance certificate was issued by the territorial authority for this 8-year-old house and 2-year-old additions.
The questions to be determined are:
- 1) Whether the monolithic wall cladding as installed to the external walls of the building complies with the Building Code and;
- 2) Whether certain building elements, which have 5 and 15-year durability requirements, comply with clause B2 of the Building Code considering the time that has elapsed since the elements of the 8-year-old part of the house were constructed.
